The Division of Training has launched a proper investigation into Burlington Public Colleges in Massachusetts, following mother and father’ accusations that the district ignored their opt-out requests and compelled college students to take part within the 2025 Youth Threat Conduct Survey (YRBS).

The probe, initiated by the Division’s Scholar Privateness Coverage Workplace (SPPO), is investigating potential violations of the Safety of Pupil Rights Modification (PPRA). This federal regulation ensures mother and father the correct to exempt their youngsters from surveys that ask for delicate, non-public data.

The YRBS, administered to college students at Marshall Simonds Center College and Burlington Excessive College in March, included express questions on matters like drug and alcohol use, psychological well being, sexual encounters, sexual orientation, and “gender identification.”

Mother and father have been notified upfront about their opt-out rights, and a number of other submitted written requests to exclude their youngsters from the survey. Regardless of this, the district allegedly required the opted-out college students to take it anyway, with at the very least one trainer reportedly forcing a pupil to take part over clear objections.

Screenshots of the survey questions, provided in a complaint filed by the Massachusetts Household Institute (MFI) and fogeys, reveal the invasive nature of the content material.

    Examples embody:

    • Questions on sexual orientation, with choices like “straight,” “lesbian,” “homosexual,” “asexual,” “bisexual,” “pansexual,” and “queer.”
    • Gender identification queries, asking college students in the event that they establish as “cisgender woman/girl,” “cisgender boy/man,” “transgender woman/girl,” “transgender boy/man,” or “nonbinary/genderqueer.”
    • Specific particulars on sexual activity, defining it to incorporate “vaginal, oral, and anal intercourse” and using “toys or props.”
    • Inquiries about pressured sexual acts and the age of first alcohol consumption, with choices as younger as “8 years previous or youthful.”
    • Flavors of tobacco merchandise used, corresponding to “fruit,” “alcohol,” “sweet,” “mint,” “menthol,” “wintergreen,” “clove,” or “spice.”

These questions have been deemed “graphic and downright inappropriate” by U.S. Secretary of Training Linda McMahon, who blasted the district’s actions.

“Mother and father should be the first decision-makers of their youngsters’s training. The allegations that Burlington violated mother and father’ rights by administering a survey towards mother and father’ needs – and significantly one that’s graphic, and downright inappropriate in nature – is unconscionable,” stated U.S. Secretary of Training Linda McMahon in a press release concerning the case. “The Division will examine this matter completely and proceed to resolutely defend mother and father’ rights.”

The grievance, detailed in a letter by Sam Whiting, Counsel at Massachusetts Liberty Authorized Heart, on behalf of fogeys, highlights Burlington’s alleged historical past of pushing radical ideologies with out opt-out choices. It references previous incidents, corresponding to selling LGBTQ+ Pleasure celebrations, racial views, and gender-nonconforming trainer pronoun use, whereas hiding data like an LGBTQ membership from mother and father.

    The letter states:

“Ordinarily, a faculty district that didn’t adjust to the PPRA could be given some leeway – federal regulation may be complicated and compliance is, understandably, not all the time good. However this isn’t the primary time that Burlington Public Colleges have violated the rights of fogeys and college students. Underneath the guise of ‘inclusion’ and ‘anti-bullying,’ BPS has for years pushed controversial and divisive sexual, racial, and political ideologies upon impressionable college students with out offering mother and father with a chance to choose their youngsters out. BPS has gone all-out to have a good time ‘LGBTQ+ Pleasure,’ decking the halls at college with flags and posters, whereas denying pro-life college students the chance to fly the pro-life flag on the college flagpole for even a day in January 2024. It has proven college students movies suggesting that each one white individuals view black males as inherently harmful. ‘Gender nonconforming’ BPS academics have pressured college students to make use of pronouns for the trainer that don’t match their organic intercourse. BPS has tried to cover the existence of an LGBTQ membership from mother and father to be able to hold them in the dead of night about their youngsters’s sexuality. The record may go on.”

The letter calls for accountability, together with potential termination for accountable employees, revised insurance policies to keep away from intrusive surveys, and obligatory PPRA coaching.

Burlington Superintendent Eric Conti responded to the investigation in a statement obtained by Campus Reform, saying the district “will cooperate absolutely with the investigation and can reply inside the time required.” He added that they stay up for resolving the matter and implementing any essential coverage modifications to guard college students’ rights.
